Jonathan Whitehead joins Pete in the first hour to discuss the case of Andrea Hernandez
Hernandez, who was threatened with expulsion for refusing to wear a chipless RFID tracking badge based on her sincere religious beliefs that it represents the “mark of the Beast,” had her request for a preliminary injunction denied by the Fifth Circuit Court of Appeals and the Western District of Texas. In coming to Andrea’s defense, Rutherford Institute attorneys alleged that the school’s attempts to penalize, discriminate and retaliate against Andrea violate her rights under Texas’ Religious Freedom Act and the First and Fourteenth Amendments to the U.S. Constitution.
John W. Whitehead is an attorney and author who has written, debated and practiced widely in the area of constitutional law and human rights. Whitehead’s concern for the persecuted and oppressed led him, in 1982, to establish The Rutherford Institute, a nonprofit civil liberties and human rights organization whose international headquarters are located in Charlottesville, Virginia. Whitehead serves as the Institute’s president and spokesperson, in addition to writing a weekly commentary that is posted on The Rutherford Institute’s website (www.rutherford.org), as well being distributed to several hundred newspapers, and hosting a national public service radio campaign. Whitehead’s aggressive, pioneering approach to civil liberties issues has earned him numerous accolades, including the Hungarian Medal of Freedom.
Whitehead serves as a member of the Constitution Project, which seeks to formulate bipartisan solutions to contemporary constitutional and legal issues by combining high-level scholarship and public education. He also serves as a member of the advisory board for the Innocence Commission for Virginia, a nonprofit, nongovernmental, nonpartisan project dedicated to supplementing the ongoing work in Virginia through recommendations to strengthen the reliability of its criminal justice system and to reduce the likelihood of future wrongful convictions.
The second hour brings Sheriff Mack to the forefront discussing the dangerous situation we are in concerning the unconstitutional gun laws being forced upon U.S. Citizens in the wake of the Newtown Elementary School Shooting.
Richard Ivan Mack is the former sheriff of Graham County, Arizona, and a two-time candidate for United States Congress. He is frequently referred to simply as “Sheriff Mack.”
Mack spent eleven years with the police department of Provo, Utah, and then moved back to Arizona to run for Graham County Sheriff in 1988. While serving as sheriff, he attended the FBI National Academy and graduated in 1992. In 1994, he was named Elected Official of the Year by the Arizona-New Mexico Coalition of Counties. He was also named the National Rifle Association Law Enforcement Officer of the Year for 1994, and was inducted into the NRA Hall of Fame.
